Welcome to My Permit Pass. By accessing or using our website and services, you agree to these Terms of Service. If you do not agree, please do not use the site.

1. About our service

My Permit Pass is an independent study tool. We are not affiliated with, endorsed by, or connected to any state Department of Motor Vehicles (DMV), Department of Public Safety (DPS), or other government agency.

Our practice questions, study guides, and educational content are designed to help you prepare for your permit or knowledge test. We do not guarantee that you will pass any official examination.

2. Eligibility

You must be at least 13 years old to use this website. If you are under 18, you should use the service with a parent or guardian's knowledge and consent where required by applicable law. Parents or guardians who permit a minor to use the site accept responsibility for that minor's compliance with these Terms.

3. Accounts and subscriptions

Some features require an account on our application platform. You are responsible for keeping your login credentials secure and for all activity under your account. You agree to notify us immediately of any unauthorized access.

Paid plans, refunds, and billing disputes are governed by our Billing Policy. Prices and plan features may change; material changes will be communicated as described in that policy.

4. Acceptable use

You agree not to:

• Copy, scrape, or redistribute our content without permission
• Attempt to reverse-engineer, disrupt, or overload our systems
• Use the service for any unlawful purpose
• Misrepresent your affiliation with My Permit Pass or any government agency
• Use automated tools to access or harvest content from the site without our prior written consent

We reserve the right to suspend or terminate access for violations of these rules.

5. Intellectual property

All content, branding, software, and materials on this site are owned by My Permit Pass or our licensors and are protected by applicable copyright and trademark laws. You receive a limited, personal, non-transferable license to use the service for your own study purposes only. Nothing in these Terms transfers any ownership rights to you.

6. Disclaimers

The service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. See our Disclaimer for additional limitations.

7. Limitation of liability

To the fullest extent permitted by applicable law, My Permit Pass and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the service, including failure to pass a DMV or equivalent exam, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising from these Terms or your use of the service shall not exceed the amount you paid us in the six months preceding the claim, or $10, whichever is greater.

8. Changes to these Terms

We may update these Terms from time to time. We will update the "Last updated" date at the top of this page when changes are made. For material changes, we will make reasonable efforts to notify you (e.g., via a notice on the site). Continued use of the site after changes are posted constitutes your acceptance of the revised Terms.

9. Governing law and forum

These Terms, and any dispute arising out of or relating to these Terms or your use of the service, are governed by the laws of the State of Nevada, without regard to its conflict-of-law principles. Subject to the arbitration agreement in Section 10, you agree that any dispute not subject to arbitration will be brought exclusively in the state or federal courts located in Clark County, Nevada, and you consent to personal jurisdiction and venue in those courts.

Nothing in this Section limits any non-waivable rights or protections you may have under the mandatory consumer-protection laws of your state of residence.

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.

10. Dispute resolution; binding arbitration; class-action waiver

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND TO HAVE A JURY TRIAL.

10.1 Informal resolution first

Before starting any arbitration, you and My Permit Pass agree to try to resolve the dispute informally. You agree to send a written notice of dispute to support@mypermitpass.com describing the problem and the relief you seek. Both parties will attempt in good faith to resolve the matter within 60 days of that notice. This step is a condition precedent to starting arbitration.

10.2 Agreement to arbitrate

If the dispute is not resolved within 60 days, you and My Permit Pass agree that any dispute, claim, or controversy arising out of or relating to these Terms or the service — whether based in contract, tort, statute, or any other legal theory — will be resolved by final and binding arbitration, rather than in court, except as stated in Section 10.5. This agreement to arbitrate is governed by the Federal Arbitration Act (9 U.S.C. §§ 1 et seq.).

10.3 Arbitration procedure

The arbitration will be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules then in effect. The arbitration may be conducted by telephone, video, or written submissions, or in person in Clark County, Nevada, at your election. The arbitrator's decision will be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.

10.4 Class-action and jury-trial waiver

You and My Permit Pass agree that each may bring claims against the other only in an individual capacity, and NOT as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person's claims and may not preside over any class or representative proceeding. BOTH PARTIES WAIVE ANY RIGHT TO A JURY TRIAL. If a court decides that this class-action waiver is unenforceable as to a particular claim or request for relief, then only that claim or request will be severed and heard in court, and all other claims will proceed in arbitration.

10.5 Exceptions

Either party may (a) bring an individual claim in small-claims court if it qualifies, and (b) seek injunctive or equitable relief in court to protect its intellectual property or confidential information. Nothing here waives any non-waivable right under applicable law.

10.6 30-day right to opt out

You may opt out of this arbitration agreement (Sections 10.2–10.4) by sending written notice to support@mypermitpass.com within 30 days of the date you first accept these Terms. Your notice must include your name, the email associated with your account, and a clear statement that you want to opt out of arbitration. Opting out will not affect any other part of these Terms.

10.7 Changes

If My Permit Pass makes a material change to this Section after you accept these Terms, you may reject that change by sending written notice within 30 days, in which case the most recent version you accepted before the change will govern.
